Template lease for CMPA ready

Attorney John Daniel has a template lease for parcels at the Community Maritime Park ready for review.

The issue is slated for the Pensacola City Council's Sept. 14 meeting. The draft is linked here, but here are some of the key points.

— Leases must state a designated use for the property and any change to that must be approved by City Council, or in some cases, the mayor's office.

— Sets a due diligence period of 60 days for proposed projects to determine if the planned use is feasible.

— Will require the leasee to specify a timetable for construction.

— Rent will increase every five years in proportion to the consumer price index and rent may be adjusted "at longer intervals to be negotiated between the parties" to be comparable to current market rate.

— Parking is the leasee's responsible to provide.

The issue of a template lease has arisen often over the years, most recently when a plan by Quint and Rishy Studer to lease three parcels at the maritime park fell apart.
